Terms of Service

1. Parties

The Service is provided by Ertunç İlbeyli, an individual developer ("Service Provider"). Users of the Service include music teachers, music students, and related parents/guardians.

2. Description of the Service

Müzik Dersim is a music education platform on which teachers can assign exercises in areas such as note reading, rhythm, ear training, piano, and guitar; students complete the assignments and additional exercises in the app; and the results are shared with the teacher.

3. Membership and Account Security

To access the Service you must create an account with a valid email address. You are responsible for ensuring that the information you provide is accurate, up to date, and complete.

You are responsible for the security of your password and for all actions performed via your account. If you suspect unauthorized access, notify iletisim@muzikdersim.com immediately.

Users under 13 require parental/guardian consent to create an account.

4. User Obligations

While using the Service you agree not to:

• Use the Service in a way that is unlawful or that infringes others' rights
• Attempt to gain unauthorized access to other users' accounts
• Reverse engineer, copy, or redistribute the app's source code
• Collect or share other people's personal data without consent
• Send messages containing abuse, harassment, advertising, or spam
• Use malicious software, viruses, or automated bots that harm the Service

5. Pricing and Premium Subscription

Teacher accounts are free and can add an unlimited number of students. The premium subscription for students provides access to additional content for ₺79 / month.

Your subscription renews automatically unless cancelled. Subscription management (cancellation, plan change) is handled via your Apple App Store or Google Play account. Price and content updates are announced in-app or by email in advance.

6. Cancellation and Refunds

Cancellations must be made at least 24 hours before the renewal date via your Apple/Google account. Refund requests are subject to Apple's and Google's own refund policies. The Service Provider does not have the authority to issue refunds for requests declined by Apple/Google.

7. Intellectual Property

The Müzik Dersim logo, designs, software code, and content belong to the Service Provider and are protected under Turkish Law on Intellectual and Artistic Works (Law No. 5846). Copying, distributing, or creating derivative works without written permission is prohibited.

By uploading content (messages, assignment data) to the Service, users grant the Service Provider a license to use, store, and process such content for the purpose of delivering the Service.

8. Service Interruptions and Changes

The Service Provider reserves the right to temporarily suspend the Service for maintenance, updates, technical failures, or force majeure. Planned interruptions will be announced in advance where possible.

The Service Provider reserves the right to add, remove, or change features. Updates that materially alter core functionality will be announced to users in advance.

9. Limitation of Liability

The Service is provided "as is". The Service Provider makes no express or implied warranties that the Service will be uninterrupted, error-free, or fit for a particular purpose.

The Service Provider is not liable for indirect damages caused by force majeure, third-party outages (Firebase, Apple, Google), or the user's negligence.

10. Suspension and Termination

Accounts that violate these terms, harm other users, or engage in unlawful conduct may be suspended or terminated without prior notice. Users may request to close their accounts at any time.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved by the Istanbul Courts and Enforcement Offices. Rights arising from consumer protection law are reserved.

12. Changes

The Service Provider reserves the right to update these terms. Material changes will be announced in-app or via email in advance. Continuing to use the Service after changes take effect constitutes acceptance of the updated terms.
